"kurspausdinti.lt" provides users with a virtual space, i.e. the Portal, where legal and natural entities providing printing services (hereinafter - Print Shops) upload information about themselves and the services they provide, and Users can submit print requests, receive offers, and after confirming offers - place printing orders. By visiting the Portal and performing any actions allowed by the Portal's functionality, the User undertakes to comply with all the requirements set out in these terms. The User is free to choose the type and scope of services they wish to use on the Portal. While changing the Portal's functionality and the quantity or nature of services provided, "kurspausdinti.lt" has the right to amend these Terms at any time. Users will always be able to access the amended Terms by publishing the latest version of the Terms on the Portal. Access to our Portal is granted temporarily. We reserve the right to discontinue or modify our website (and any products or services offered on it) without notice. We accept no liability if our website or any part of it is unavailable for any reason at any given time.

"kurspausdinti.lt" will in no way be involved in transactions concluded between Portal users and Print Shops for the performance of selected Services, "kurspausdinti.lt" will have no legal obligations related to such transactions between Print Shops and their service recipients, and in no case will "kurspausdinti.lt" guarantee or be responsible for the proper provision of services. The User acknowledges and agrees that they themselves, and not "kurspausdinti.lt", are responsible for any and all information (hereinafter - Information) sent or otherwise transmitted by them while using the Portal and/or Services, and the legal relations associated with it. While using the Portal and/or its Services, the User must respect and not violate established norms of behaviour and morality, must not violate legal requirements or the rights and legitimate interests of third parties, including legislation regulating the protection of intellectual property, personal data, advertising and other matters.

• a) intentionally distributing viruses, Trojans, worms, logic bombs, time bombs, keystroke loggers, spyware, adware or other material, programs or code that has (or is programmed to have) a negative effect on the operation of any computer or hardware software; and/or
• b) unlawfully accessing or attempting to unlawfully access our website server or any server, computer or database connected to our website; and/or
• c) attacking our website with a denial-of-service or distributed denial-of-service cyber attack.
• d) impersonating any other person or entity, including but not limited to "kurspausdinti.lt" employees, or otherwise misrepresenting your relationship with any persons.

In addition to the above, the User undertakes not to use the Portal and/or Services:

• a) for any actions that could harm any persons, their property or legitimate interests.
• b) for the distribution of information prohibited by law, offensive, deceptive, threatening, infringing or other similar Information.
• c) infringing the rights of persons to intellectual property, including economic copyrights or trademark rights.

Violation of these requirements may be considered a criminal offence under the Criminal Code. We will report such violations to the relevant law enforcement authorities and cooperate with them by disclosing your identity. In the event of such a violation, you immediately lose the right to use our website and/or its Services. The User agrees that "kurspausdinti.lt" will unilaterally decide whether the User has violated these Terms and undertakes to recognise any decision of "kurspausdinti.lt" as legal and fair.

The User understands and agrees that "kurspausdinti.lt" does not control the Information of other users or third parties that the User may receive, read or otherwise become aware of while using the Portal or the Services, and therefore "kurspausdinti.lt" does not guarantee the accuracy, integrity or quality of such information.

When modifying the Portal and/or changing the Services provided for any reason, "kurspausdinti.lt" reserves the right to change the Portal and/or the Services provided, as well as the information presented on the Portal, at any time without notifying the User. The User understands and agrees that "kurspausdinti.lt" will never be held responsible for any negative consequences caused to the User by such or other similar actions.

"kurspausdinti.lt" has the right at any time, without prior notice:

• a) to delete and/or modify all or part of the User's Login data, as well as other information that the User submits in any way while using the Portal Services, if the User violates these Terms while using the Portal and/or other applicable laws of the Republic of Lithuania.
• b) "kurspausdinti.lt" has the right during preventive or other works to restrict or terminate the provision of Portal Services for an appropriate period.

The parties agree that "kurspausdinti.lt" has the right at any time, without prior notice, to terminate the operation of the Portal. The User has the right at any time to refuse to use the Services by deleting their Login data and order data in the manner indicated on the Portal.

The User understands and agrees that all of the User's personal information (including but not limited to Login data) and all Information that they submit in any way while using the Portal may be retained for 10 years from the User's last visit to the Portal.

The User understands that they themselves, and not "kurspausdinti.lt", are responsible for all Information sent, viewed, stored or distributed by the User while using the Portal and/or its Services.

The User understands and agrees that "kurspausdinti.lt" has the right, but not the obligation, at its discretion to check the Information received and transmitted by the User in order to detect undesirable Information or Information violating these Terms, and upon detecting such Information - to remove it or block any transmission of such Information.

All rights to the Portal and the works contained in it are protected. No information on the Portal may be reproduced, made publicly available or distributed without the prior written consent of "kurspausdinti.lt".

You may connect to this website, view and print one copy of it, as well as one copy of the information, images and other content on the website (excluding user-generated content) (hereinafter - the Material) only in strict compliance with these terms of use of the website.

You may view, print, use, quote and refer to the website and the Material only for your personal, non-commercial purposes and on condition that you acknowledge that the proprietary rights to such information belong to "kurspausdinti.lt".

Nothing in the above rights diminishes or restricts the moral rights of the author in respect of the Material.

We expressly reserve all intellectual property rights in the Material on the website, and you may use the Material on the website with certain restrictions, under which you are prohibited from:

• a) removing any copyright notices or other proprietary information contained in the Material; and/or
• b) using the Material on the website in a way that may infringe our or any third party's copyright, intellectual property rights or proprietary rights; and/or
• c) using or encouraging others to use any automated system or software to extract content or data from this website ("screen scraping"), unless you or the relevant third party have entered into a written licence agreement directly with us under which such activity is permitted; and/or
• d) reproducing, modifying, displaying, performing, publishing, distributing, disseminating, broadcasting, framing (or using any other browser or framed environment), or transmitting to a publicly available space.

The User agrees that "Kurspausdinti.lt" is an electronic platform that provides intermediary services connecting customers with printing service providers.

"Kurspausdinti.lt" will in no case be liable for the quality and final result of printing services provided by the Services on the Portal.

"Kurspausdinti.lt" is not liable for any damage and/or losses that the User may suffer while using the Portal and/or services and uploading, sending, otherwise transmitting or making publicly available any Information.

The User understands and agrees that "Kurspausdinti.lt" will not be liable for any Information reaching the User or other third parties while using the Portal and/or services, losses or damage caused by such Information or the publication, receipt, sending or other transmission of such Information using the Services.

The User understands and agrees that "Kurspausdinti.lt" will never and for any reason be liable for all and any of its actions or omissions related to the User's use of the Portal and/or services and compliance with these Terms. The User assumes full responsibility for any damages or losses of any nature that may arise to them or third parties in any way while the User uses the Portal or Services.

The User undertakes to ensure that "Kurspausdinti.lt" never incurs any legal liability, obligation to pay, compensate or otherwise reimburse any losses, damages or other expenses arising from the User's actions that violate these Terms and/or other legislation of the Republic of Lithuania while the User uses the Portal and/or Services.

We accept no liability for inadequate maintenance of the website and/or delayed or failed delivery of any Material. We are not liable for any losses arising from your actions or omissions based on the Material on this website. However, nothing in these terms of use of the website affects your statutory rights or limits our liability for death or personal injury caused by our negligence, or for liability due to intent or gross negligence and/or any other liability that cannot be excluded or limited under Lithuanian law. The Material may contain inaccuracies and typographical errors. We do not guarantee that the Material will be accurate or complete.

"Kurspausdinti.lt" provides a 30-day guarantee to provide impartial intermediary consultation when the User submits a complaint about the quality of work or services performed that were provided after registering through the Portal. Such a complaint should be submitted no later than 30 days after the printing order or receipt of services. The complaint form should include general information (order number, printing job details, copy of the work estimate, order amount) and this form should be sent by email to [email protected]. The "Kurspausdinti.lt" team responds to all submissions within 5 business days.

• a) For inadequate maintenance of the website and/or delayed or failed delivery of any Material.
• b) In all cases provided for by law, we do not assume and do not recognise any guarantees, terms, conditions and statements that may otherwise be provided for by law in respect of this website, i.e. we make no representations and do not guarantee that the website will be free of errors, will not contain viruses or other harmful components, or that defects will be corrected. In this respect you must take your own precautions.
• c) In any case, we will not be liable for any damages or losses caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our website.

Please note that our Portal is intended for internal and private use only, and therefore you confirm that you will not use our website for commercial or business purposes, except where you have been approved as a Partner.

We accept no liability for the following losses (even if such losses are foreseen): loss of revenue or income, loss of business, loss of profits, loss of anticipated savings, loss of data or wasted management or staff time.

The Portal may contain advertising provided by third parties. Such third parties are solely responsible for the content of such advertising and must ensure that it complies with all applicable laws and regulations. We accept no liability for the content of third-party advertising.

The parties agree that these Terms shall prevail over all explanations and Service descriptions available to the User on the Portal, as well as that all disputes between the parties shall be resolved on the basis of these Terms and their text.

All disagreements between the User and "Kurspausdinti.lt" regarding the implementation of these Terms shall be resolved through negotiations. If the parties fail to resolve a dispute through negotiations within 30 (thirty) days from the day on which one of the parties has submitted to the other a request to resolve the dispute, such dispute shall be finally resolved in accordance with the laws of the Republic of Lithuania in courts at the place of residence of "Kurspausdinti.lt".
